Terms of Use

Please read these Terms of Use carefully before downloading or using any app, website, or service operated by SmerDev Studio LLC ("we," "us," or "our"). By installing or using our apps or services, you agree to be bound by these Terms. If you do not agree, do not use our apps or services.

Acceptance of Terms

By accessing or using SmerDev Studio apps or services, you confirm that you are at least 13 years of age and agree to these Terms and our Privacy Policy. If you are using an app on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

License to Use Our Apps

Subject to these Terms, SmerDev Studio LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use our apps on Apple-branded devices you own or control, solely for your personal, non-commercial purposes. You may not copy, modify, distribute, sell, reverse engineer, rent, lease, or lend any of our apps to any third party. You may not use our apps for any unlawful or unauthorized purpose.

In-App Purchases and Subscriptions

Some of our apps offer in-app purchases and auto-renewable subscriptions. Subscription pricing and duration are displayed in the app at the time of purchase in your local currency. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage and cancel subscriptions at any time through your Apple Account Settings. Canceling a subscription does not provide a refund for the current billing period. For refund requests, contact Apple directly at reportaproblem.apple.com.

Your Content

You retain ownership of any content you create or enter into our apps. By using features that transmit or store content through our services or third-party providers, you grant SmerDev Studio LLC a limited license to process that content solely to provide the app functionality you requested. We do not claim ownership of your content.

AI Features

Some SmerDev Studio apps include AI-powered features for planning, research, organization, text assistance, guidance, or productivity workflows. When you use those features, the content you submit may be processed by third-party AI service providers to generate a response. Do not enter sensitive personal, medical, legal, financial, or confidential information unless you are comfortable with it being processed for that feature. AI-generated content is provided for informational purposes only and should not be relied upon as professional advice.

Prohibited Uses

You agree not to use our apps or services to violate any applicable law or regulation, infringe any intellectual property or other rights of any person, transmit any harmful, offensive, or unlawful content, attempt to gain unauthorized access to any system or network, or interfere with the proper functioning of our apps or services.

Intellectual Property

Our apps and all content, features, and functionality — including but not limited to text, graphics, logos, icons, and software — are the exclusive property of SmerDev Studio LLC and are protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

Third-Party Services

Our apps may integrate with trusted third-party services for hosting, authentication, analytics, crash reporting, subscriptions, cloud storage, maps, notifications, AI processing, or other infrastructure. Your use of third-party services is subject to their own terms and privacy policies. SmerDev Studio LLC is not responsible for the practices or content of third-party services.

Disclaimer of Warranties

Our apps and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that our apps will be uninterrupted, error-free, or free of harmful components. Any information or content provided through our apps is for general informational purposes only and does not constitute professional advice of any kind.

Limitation of Liability

To the maximum extent permitted by applicable law, SmerDev Studio LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or property, arising from or related to your use of or inability to use our apps, even if we have been advised of the possibility of such damages. Our total liability to you for all claims arising from or related to our apps shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Termination

We reserve the right to suspend or terminate your access to our apps at any time for any reason, including violation of these Terms. You may stop using any app at any time by deleting it from your device. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the date at the top of this page. Continued use of our apps or services after an update means the revised Terms apply.

Governing Law

These Terms are governed by the laws of the State of Maine, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Maine.
